Online casinos in Idaho: what the law says
Idaho has no legal online casino or sports betting, and its gambling statute exempts promotional contests only when incidental to a bona fide non-gaming business.
No licensed online casino in Idaho
Idaho's regulator lists online casinos as not legal. Idaho's constitution bans gambling outright rather than merely leaving it unauthorised. Article III, Section 20 says gambling "is contrary to public policy and is strictly prohibited" apart from three named exceptions - a state lottery, pari-mutuel betting and charitable bingo and raffles - and subsection (2) adds that none of those exceptions may "employ any form of casino gambling" or "any electronic or electromechanical imitation or simulation of any form of casino gambling." Sports betting is not one of the three exceptions, and Idaho Code 18-3801 removes any doubt by defining gambling to include risking money on "the happening or outcome of an event, including a sporting event." Placing a bet is a misdemeanour under Idaho Code 18-3802 and taking bets is separately punished as bookmaking or pool selling under Idaho Code 18-3809.
Three things, exactly as the constitution lists them. The Idaho Lottery (Idaho Code Title 67, Chapter 74) runs the state lottery and also licenses charitable bingo and raffle organisations through its Charitable Gaming programme. Pari-mutuel horse race betting is allowed by Idaho Code 54-2512, which legalises pari-mutuel wagering and declares other betting illegal, and is overseen by the Idaho State Racing Commission, a division of the Idaho State Police. Separately, Idaho Code 67-429B provides that "Indian tribes are authorized to conduct gaming using tribal video gaming machines pursuant to state-tribal gaming compacts which specifically permit their use," and that such a machine "may be used to conduct gaming only by an Indian tribe."
