Online casinos in New Mexico: what the law says
New Mexico sports betting is offered only at tribal casinos; online casino gaming is not legal.
No licensed online casino in New Mexico
New Mexico's regulator lists online casinos as not legal. New Mexico has NO state authorizing statute for sports betting at all. Sports betting exists purely under Class III tribal gaming compacts, on-site at tribal casinos. The Office of the State Gaming Representative told the Legislature's Indian Affairs Committee on 2025-09-25, in a handout published on nmlegis.gov, that sports betting is limited to on-site wagering only at tribal casinos chosen to open sportsbooks, that New Mexico law has not legalized either retail or online wagering elsewhere, and that only eight casinos currently offer sports betting. The same handout shows the compacts anticipate but do not permit internet gaming: if internet gaming is authorized within the State, the State and the Tribe agree to reopen good faith negotiations to evaluate its impact and consider adjustments to the Compact. This is tribal-compact exclusivity in its purest form, and it means any online expansion is a compact renegotiation rather than a simple bill. Nothing is moving legislatively: the 2026 Regular Session is a 30-day session constitutionally limited under Art. 4, Sec. 5(B) to budget, appropriations and revenue bills, bills drawn pursuant to special messages of the governor, and previously vetoed bills; its full official listing of 812 measures contains not one with gaming, gambling, wagering, betting or casino in the title. The 2025 60-day session had eleven gaming bills, but all concerned Gaming Control Board administration, gaming machine standards, horse racing, racetrack licensing or gaming tax, none online.
