Online casinos in North Dakota: what the law says

No licensed online casino in North Dakota

North Dakota's regulator lists online casinos as not legal. Tribal casinos only. The ND Attorney General's gaming page states flatly that state law prohibits online gaming in North Dakota, with an exemption only for state-licensed charitable gaming organizations to run online raffles through a licensed North Dakota distributor, and describes the tribal-state gaming compacts as authorizing the state's Native American tribes to conduct gaming at casinos on tribal land, across five Indian casinos. Art. XI, Sec. 25 of the ND Constitution bars the legislative assembly from authorizing any game of chance except the multi-state lottery and charitable gaming, so sports betting of any kind requires a CONSTITUTIONAL AMENDMENT. The legislature is biennial; the 69th Legislative Assembly's regular session was 2025 and there is no 2026 regular session. Two 2026 special sessions were held (January and September 2026) and neither has any gaming, games-of-chance or gambling entry in its official Major Topics Index. IMPORTANT CAVEAT on HCR 3002 below: its engrossed text is a generic enabler reading 'May authorize sports betting on professional and college sports to be conducted in the state and licensed and regulated by the state', with no mention of online, mobile or internet wagering. It would have permitted the legislature to authorize online sports betting but does not itself do so; it is recorded here because it is the only sports-betting measure in the session and its failure is the state's clearest directional signal.
