Online casinos in South Dakota: what the law says
South Dakota allows sports wagering only in Deadwood casinos and tribal casinos; online casino gaming is not legal.
No licensed online casino in South Dakota
South Dakota's regulator lists online casinos as not legal. Sports betting is legal but confined to Deadwood and tribal casinos, on premises. SD Constitution Article III, Sec. 25 ('Games of chance prohibited--Exceptions') provides that the Legislature may not authorize any game of chance, lottery or gift enterprise under any pretense or for any purpose, subject to listed exceptions, and the relevant exception makes it lawful for the Legislature to authorize roulette, keno, craps, wagering on sporting events, limited card games and slot machines only within the city limits of Deadwood. Tribal casinos operate separately under IGRA. Statewide mobile or online sports betting therefore requires a CONSTITUTIONAL AMENDMENT, which is why the vehicles are Joint Resolutions. South Dakota does NOT carry bills over between annual sessions; SJR 504 below is the 2026 re-run of SJR 507, which was 'Tabled' in Senate Commerce and Energy on 2025-02-13 (https://sdlegislature.gov/Session/Bill/26221). No online casino / iGaming bill exists in 2025 or 2026. Worth separating out so it is not miscounted: HB 1058 (2026), requiring licensure for online pari-mutuel wagering pools for horse and dog races, WAS signed by the Governor on 2026-02-17, but that is pari-mutuel racing, not sports betting or online casino.
